From April this year, those who are separating will have the option of being able to divorce based upon the fact of “no fault”. This is a welcome change and a long overdue one.
Many couples who consider divorce up until now have had to petition based upon facts which they do not necessarily wish to rely on, or indeed use, as it can often cause more conflict, in particular the fact of unreasonable behaviour.
The new legislation, however, will enable there to be less conflict and that can only mean positive steps for people who are divorcing/separating especially where children are involved.
Akin to that, parents separating will need to consider “child custody arrangements” – what we Mediators prefer to refer to as “child arrangements” and often, financial matters including a family home, other assets and pensions
